What happens if Americable contacts me to discuss my excessive Internet usage and I continue to use my Americable service at extremely high volumes?

Americable will only continue to monitor your internet usage if it remains excessive and continues to violate the terms of the Americable International Inc. User Agreement. Americable reserves the right to suspend, terminate, or limit your Internet Service.

(User Agreement, paragraph 6) – Subscriber acknowledges and agrees that Americable shall have the right to monitor Subscriber’s bandwidth consumption” (i.e. aggregate volume of data that may be sent or received) at any time and on an on-going basis, and to limit excessive bandwidth consumption by the Subscriber (as determined by Americable) by any means available to Americable, including suspension or termination of the customer’s Service.  Americable has determined that excessive bandwidth consumption is considered to be anything exceeding 200 Gigabytes per month of aggregate volume of data that has been sent or received by the customer.

(User Agreement, paragraph 7) – If Subscriber exceeds the bandwidth consumption limits assigned to the level of ISP Service for which Subscriber has subscribed in any month, Americable (or ISP if ISP is billing Subscriber for ISP Service) has the right to limit bandwidth consumption by Subscriber in excess of such level by any means available to Americable or ISP, including suspension of ISP Service, and/or to impose additional fees and charges on Subscriber.  The rate for excess consumption of bandwidth will be charged at the rate of @$12.50 per 50 Gigabytes above the allowable per month service offering.
